Babrush Studio is a brand under which the Seller offers artistic and lifestyle products, including greeting cards, art prints and reproductions, original artworks, custom-made products and selected products manufactured by production partners.

These Terms & Conditions govern the use of the online store, the placement and fulfilment of orders, and the rights and obligations of the Customer and the Seller.

2. Products

Products available through the store may include, in particular:

  • greeting cards and stationery,
  • art prints and reproductions,
  • original artworks,
  • handmade and hand-finished products,
  • personalised and custom-made products,
  • products manufactured or fulfilled by Babrush Studio’s production partners.

The main characteristics of each product are described on its product page.

We make every reasonable effort to represent our products accurately in photographs and descriptions. However, handmade and hand-finished products may vary slightly from one piece to another in colour, texture, paper edges, cutting, placement or finish.

Such natural variations are part of the individual character of handmade products and do not in themselves constitute a defect, provided that the product conforms to its description and agreed characteristics.

3. Prices

Product prices are displayed in the currencies available in the store.

Before placing an order, the Customer will be informed of the total price of the products, delivery costs and any other charges collected by the Seller, where applicable.

Orders delivered outside the European Union may be subject to customs duties, import taxes or other charges imposed by the destination country. Further information is provided in our Shipping & Returns Policy.

4. Placing an Order

Orders may be placed through the Babrush Studio online store.

Creating an account is not required to make a purchase. Customers may place an order as a guest or create an optional account which may provide access to features such as order history.

Before placing an order, the Customer has the opportunity to review the selected products, quantities, prices, delivery costs and other order details.

An order requiring payment is placed by using a button that clearly indicates that placing the order creates an obligation to pay.

After an order has been placed, the Customer will receive confirmation at the email address provided during checkout.

5. Payments

Available payment methods are displayed during checkout.

For standard orders placed through the online store, the full amount is payable when the order is placed.

Payments may be processed by third-party payment providers, including Stripe and PayPal, subject to their applicable terms and conditions.

6. Fulfilment and Delivery

Babrush Studio products are shipped from Poland unless otherwise stated on the relevant product page or during checkout.

Certain products may be manufactured and shipped directly by a production partner working with Babrush Studio.

As a result, a single order may be divided into two or more separate shipments.

Available delivery methods, costs and estimated delivery times are displayed during checkout or on the relevant product page.

7. Personalised and Custom-Made Products

Certain products may be created according to the Customer’s individual requirements, for example with personalised wording, company branding, a modified design or other individually agreed features.

For custom orders, the scope of the work, price, estimated completion time and approval process may be agreed with the Customer before production begins.

Where an order requires the preparation of an individual design, production will begin after the Customer has approved the agreed version of the design.

Larger or individual business orders may be subject to separate B2B terms agreed between the Customer and the Seller.

8. Right of Withdrawal

A consumer who enters into a distance contract through the store generally has the right to withdraw from the contract without giving a reason within 14 days of receiving the product.

Where a single order contains several products delivered separately, the withdrawal period may be calculated from receipt of the last product, lot or piece, as provided by applicable law.

To exercise the right of withdrawal, the consumer must inform the Seller of their decision by means of a clear statement. The consumer may use the model withdrawal form provided by the Seller, but use of the form is not mandatory.

After notifying the Seller of the withdrawal, the consumer must return the product without undue delay and no later than 14 days after communicating the decision to withdraw.

The direct cost of returning a standard product following a change-of-mind withdrawal is borne by the consumer unless the Seller agrees otherwise.

In the event of a valid withdrawal, the Seller will refund the payments required by applicable consumer law, including the cost of the least expensive standard delivery method offered by the Seller.

The Seller may withhold reimbursement until the returned goods have been received or the consumer provides evidence that the goods have been sent back, whichever occurs first.

9. Exceptions to the Right of Withdrawal

The right of withdrawal may not apply in circumstances provided for by applicable law, including where goods are made to the consumer’s specifications or are clearly personalised.

This may include, for example, a product created with personalised wording, a company logo, an individual design or other specifications requested by the Customer.

A product is not considered personalised solely because it is handmade, hand-finished or produced after the order has been placed. Standard products from the Babrush Studio collection remain subject to the usual withdrawal rules.

10. Complaints and Conformity of Products

The Seller is responsible to consumers for the conformity of products with the contract in accordance with applicable consumer law.

If a product arrives damaged, is faulty, does not match its description or the Customer receives a different product from the one ordered, the Customer should contact:

When contacting us, it is helpful to provide the order number, a description of the problem and, where appropriate, photographs of the product or packaging.

The Seller will handle the complaint and provide the remedies available to the consumer under applicable law.

Nothing in these Terms & Conditions limits the consumer’s statutory rights.

11. Original Artworks

Ready-made original artworks offered through the store may be purchased under the same general rules as other standard products.

Original artworks commissioned or created according to the Customer’s individual specifications may be subject to the rules applicable to personalised and custom-made products.

12. Copyright and Intellectual Property

Purchasing a Babrush Studio product does not transfer copyright or other intellectual property rights in the artwork, illustration or design to the Customer.

Unless expressly agreed otherwise, purchasing a physical product does not give the Customer the right to reproduce, copy, scan, distribute or commercially exploit the artwork or design appearing on that product.

For individual commercial commissions, the scope of any licence or transfer of rights may be agreed separately.

Where the Customer supplies materials such as a logo, text, photograph or other content for use in a custom project, the Customer confirms that they have the necessary rights or permissions to allow those materials to be used for the purpose of fulfilling the order.

13. Customer Accounts

Creating a customer account is voluntary and free of charge.

Customers are responsible for keeping their account login details confidential.

14. Personal Data

Customers’ personal data may be processed where necessary for purposes including order fulfilment, payment processing, delivery, customer account management and communication with the Customer.

15. Governing Law and Final Provisions

Contracts concluded through the store are governed by Polish law, without prejudice to any mandatory consumer protection rights that may apply under the laws of the consumer’s country of residence.

Nothing in these Terms & Conditions is intended to exclude or restrict any rights granted to consumers under mandatory applicable law.

The Seller may update these Terms & Conditions where necessary due to legal, technical or organisational changes affecting the operation of the store. Changes will not affect rights arising from contracts concluded before the updated Terms came into effect.
